11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located within the Republic of South Africa.

12. Arbitration Agreement

By using the Site, you agree that any disputes, claims, or controversies arising out of or in connection with these Terms or the use of the Site shall be resolved exclusively through binding arbitration, rather than in court. This arbitration will be administered by the Arbitration Foundation of Southern Africa (AFSA) under its rules and conducted in Sandton, Johannesburg. The arbitration award shall be final and binding on both parties and may be entered as a judgment in any court of competent jurisdiction.

Exceptions to Arbitration: You and Choozimo retain the right to bring an individual claim in small claims court and to seek injunctive or equitable relief in a court of competent jurisdiction in the Republic of South Africa to protect intellectual property rights.
